Hi All ,

We were selected from EOI on 04 Aug 2004 under skilled migrant category .
We got the Work to Residence Visa on Jan 2006.

We moved to NZ in April 2006 and my husband (Primary Applicant) got a job in May 2007. We applied for PR in August 2006 with 3 months’ salary, letter from the employer and other required info.

My Husband is working as contractor ( IT Project Co-ordinator in an MNC ) he got the job offer through a IT Consulting Company. He has contract agreement with Consulting Company for indefinite period. When we checked with immigration if we can work as contractor and apply for PR they said yes .

After 10 months our Visa Officer send a letter yd stating that my husband is contractor that means he is self-employed and does not come under skilled migrant category ( even though he is working in IT sector ) and they may have to reject the application for the above said reason .

We checked in the website and other documents there has been no mention about not being able to work as contractor .

We were asked to provide our comments in response to these concerns.

we are so confused on what to do next . Any advise or suggestion will be of great help .

I have absolutely no advice to give you at all, I just wanted to wish you all the very best with your application.

I think that would be my first step were I in your situation and see what alternatives or suggestions they come up with.

Yes we have sent a reply to Visa officer that we were not aware of the ineligibility if the employment is contract and asked for an appointment with him.

Hope he replies soon :)

What about asking for some support from the IT consulting company? Are they NZ based? Presumably they have made some money out of your husband, perhaps they could help.

Has your husband considered talking to the company he's under contract with to see whether they would consider giving him a fulltime position? They might not agree to do this but surely it wouldn't hurt to tell them the circumstances and ask.

Could your OH look for another permanent job? Maybe after the contract runs out. Also, you may be able to extend your visa to give yourself more time. Unfortunately I don't know how to do that, I've only heard several people talk about extensions on the forum.

I'm sorry I don't have any advice to add, I just wanted to wish you the very best of luck with the meeting with your case worker. Any chance when you were told it was OK to take the job it was confirmed in writing?
