Anyone ever entered a fixed term rental agreement over here ??
We had only been in NZ two weeks, having to find accomodation pretty sharpish or pay $1000 dollars a week to a Motel.
Luckily, we found a holiday cottage that we could rent out of season, having the cottage until 20th September.
About 3 weeks ago we decided we better start looking around for houses, as before we know it, September would be here and we would be homeless again as we couldnt extend the rent here.
We put an offer in for a house as well as others did, and came out on top - the offer was accepted. We were thrilled, as had heard of so many people on this forum that had been messed around.
In meantime, landlords had buggered off the Australia for 3 monthes, leaving us with no telephone number or contact, etc. We felt extremely let down!
Someone was picking up their mail so we posted a letter to them (their house in same grounds as our cottage) and emailed them, advising them of what had happened and asking if we could be released 6 weeks earlier than the contract would finish.
We had a very nasty reply from them, of which i wont go much into but basically stating that we would not be released from the contract, as well as a few other nasty comments.... We offered to help get new tenants in with the help if their son who live a few streets away - they replied they were too selective to do that!! Cant believe they dont trust their own sons advise!!
I have rang the tenancy tribunal for advice and had nothing but jargon thrown at me. They did say that we had entered a legal agreement and if we did leave , would be liable to pay reminder of rental contract money and could be taken to a tribunal. They did also mention if there was a clause in the agreement stating about agreement to sub let - as i didnt have agreement with me i couldnt answer. Ihave since looked at and the reference he made comment to hasnt been altered which makes us think that we could sub let.
Anyone been in a similar situation ??
