Hi,
Sorry, another query......
if my 3 children & i come over on OH SM visa, do i have to apply for my own work permit when im out there, or am i automatically entitled to work?
Alos does any one know if i have to still apply for my children to have student visas if they r on my OH visa?
Any help or advice is most welcome!!:)

From what I understand, you will need a work visa and your kinds will need student visas, but I'm pretty sure there's a way to do it through your OH's application so you don't have to submit new ones.
Perhaps someone who has already gone through it will comment and let you know some details.

I think temporary work permits exclude spouses and children, but longer term work permits allow you to get an open permit (so you can work in any employment, including self employment) and children will get study permits. You can check this on www.immigration.govt.nz . Legally you do need to be in possession of the permits though, even if you are entitled to them anyway...but this is just formality. You will probably have to prove you are in a stable partnership though?

You OH is applying for a Skilled Migrant Visa, I am assuming that this would be a WTR or a PR that you are actually applying for.
In either case, your details and your childrens are also submitted with OH application and you will be granted an open work visa and your children student visas.
So to answer your question, no you are not automatically entitled to work, but you are entitled to a work visa which entitles you to work.
Your children will need student visas which they will be entitled to.

I might be way off track here but isn't the OP's OH applying for Permanent Residency through the Skilled Migrant channel? And presumably the whole family is included in the application? So if the application for PR is granted, then the whole family become permanent residents? And that means that the adults are free to work, and the children to attend school?
In our case, my OH originally applied for a Work Permit (which was granted) and I was awarded an Open WP as his spouse. So we could both work.
After some time we decided to apply for PR through the Skilled Migrant channel. OH was the main applicant. We (i.e. both of us) were granted PR as a result. Our work permits then became null and void and we were both free to work as and when we wanted. We don't need work permits to do so.
My understanding is that if your family's application for PR is granted then you will not need a seaerate permit to work in NZ - as a resident you will have that right anyway. And presumably your children can attend school without requiring seperate permits.
Might all be different with WTR - I have no experience of this.

We got PR with my husband being the main applicant and there was no problem for me to find a job. I actually found one before he did ! No prob for kids regarding schools, child benefit, etc.. as long as your family has PR.

Oops, my description is correct for WTR but the terms are not correct for PR.
For PR, the principal is the same (your details are submitted along with the principal applicants) but instead of you getting a work visa and your children student visas you will all instead get an RRV (returning residence visa)

It has been a great help. i thought as we were applying as a family, that we would all get the correct visas, but it didnt actually state this anywhere so i thought it better to check!

Sorry, I'm confused :confused: (Ha ha not difficult I know). What permit are you applying for?? Is it a permanent residence permit, a work to residence permit or a work permit?
