If my wife is applying for Talent Visa, which Visa will I get? A lady at NZIS London said I would get an Open Work Visa, which allows me to work for anyone, including myself, but the HR people at my wife's employer say I will not be permitted self-employment.
Who is correct? Has anyone else been down this path?

Hi Mark,
I can see why you are confused, the immigration website doesn't really state anything specific and you are getting conflicting information.
From what I can gather, you would have the option of getting a visitor visa or an open work visa/permit.
As we came in on a WTR (also with wife as principal applicant), I got an open work permit which would allow me to take up any job if I wanted to.
NZIS will only be interested in what the principal applicant does, you are free to work or not.
You have already been told all this by NZIS anyway and I would take their word over someone at HR :yes

Yes, that's what I was thinking, too, but they do have a good habit of making things more complicated than they need to be!
Thanks for the info. :)

Sorry to come back to this, but did you complete form NZIS 1015 and, if so, which boxes did you tick, specifically:
Do I apply for a work permit and work visa together?
Do I select 'General Work' as my policy, or should I enter something else under 'Other'?
Question A12, 'Are you applying for a visa/permit on the basis of a partnership?': is this what I'm doing, even though my wife doesn't yet have a visa? There doesn't appear to be any other way to link our applications.
Do I just ignore the many references to job offers throughout the document? There doesn't appear to be any mention of the principle applicant's family members.
There's very little help for family members on the Immigration website and, particularly, the phone line is fairly inconsistent with the information given out. I just want to apply for a simple open work visa and there's no mention of it anywhere!
Thanks for your help.

Well, I filled in the form more than 2 years ago now so please excuse me if the answers are not 100% :)
At first I thought you were asking about applying for WTR, but realised that you are asking specifically for your personal application that is done at the same time as your wifes WTR application :yes .
1. Yes, you need to apply for both, the work visa so you can fly to NZ and work permit so that you are permitted to work there.
2. I selected General Work option.
3. Yes, I filled in question A12. For 'do you intend to apply for partnership under Partnership policy' we answered No.
4. You answer No to any job offer in New Zealand (A26)
I think that as long as you submit both applications at the same time there won't be any problems or confusion.

Hi!
We've just come over on that route, with myself as the principal applicant on a work talent visa.
I thought my hubby's work visa was based on the partnership, but I really can't be sure - sorry to be so vague, it was only a few months ago too!
Be sure to get a work visa for yourself though, rather than a visitors. You might not want to work, but if you change your mind, you have the flexibility to do so.
Good luck! The paperwork is a total pain. It took me an entire afternoon to fill in the 3 visa apps (one each for me, hubby and little'un), and sort out all the things to be sent off - and do the photocopying!
Where are you moving to?

Hi Jane, how quick we forget :yes
Yes the visa is basis of a partnership but it's No to apply under the partnership policy. If you were to answer yes to this question then you have to answer the next question
"will your New Zealand citizen or resident partner be eligible to sponsor this application and any application for residence under Partnership policy
within 12 months?"
Which of course you can't, that is why I'm pretty sure that it is No to this part of the question.

Hi Ian, yes that sounds familiar.
I think the angst of ploughing through so much paperwork at once, was so traumatic that my brain has blocked out the details....:)

Thanks, Jane and Ian, for your help. Last night we negotiated our way through the plethora of information required and I'm finally popping them in the post today. Fingers crossed from this point, I believe! :)
We're heading for Dunedin in May, should the visas go through.
