OK I'll try and keep this as short as possible. We bought a house back in December. We were really lucky and managed to get it to go unconditional with the owner on the day it was supposed to go to mortgagee sale.
Moving day was 15th Jan, this came and went with no sign of the vendor moving out. Then today our lawyer phones up to tell us that the vendor has finally vacated the property but that we can't complete until Wednesday because the receiver is on holiday.

This is the first mention we have had of a receiver and now we have got worried about whether the receiver can take our dream house away from us?:wah

Any knowledge will be much appreciated!!

If he was in receivership (bankrupt) then he was just doing as he was told, he can't do much without the banks' say so. Your lawyer has been a bit remiss in not telling you the ins and outs of what is going to happen with this sale.

I doubt very much you will lose the house, the receiver is paid to make sure things like this don't happen, it is just a shame it has all happened over the new year break. I took over a business a few years ago about that time and it felt like NZ had ground to a halt for 3 weeks. It's infuriating, but you just have to be patient.

How are things in Dville? I'm not too far away.

the receiver's not after the property, just what it has generated in cash to repay debts.
