Hi all,

We've got a bit of a dilema and was hoping somebody might be able to help.

We have come over on working holiday visas, my wife has just been offered a job as a legal secretary paying $50,000k and we would like to apply for a work permit. The problem is now that we have to go down the essential skills route instead of a work to residency (which I am lead to believe you need $55k to do).

The company who offered her the job have now come back and said they are not sure if she will be able to get the visa as they will have to prove they have offered the job to New Zealanders first (which I had heard about before, but was under the impression that if your job is skill level 3 or below on the ANZSCO then this wouldnt be the case)? Would anyone please be able to offer some advice, we are afraid that this perfect job might just slip away unless we can show them some hard evidence that this is the case.

they have to prove they advertised for a certain amount of time, not sure how long and that no one suitable took the role.

We got work visa with my role in recruitment, no quals, she just provided letter and copy of adverts. then we went for PR when OH got an IT role as he was the principal applicant. It helped once he got a work permit on the back of mine. Speak with immigrations as to what you have to supply. There is a tab for employers on the application page I believe for work permits.

I could be wrong on this, but I seem to remember that only $45,000 as a salary is needed. The idea is that a $55,000 salary is needed at the end of a WTR visa but $45,000 to begin with is fine. I'll try to find where I read this so I can make sure myself.

Can't she get a GWV to begin with then possibly later down the line she may get a pay rise which will take her to the $55k salary she needs to appy for her WTR.

Also, being of a similar occupation as her I have researched this extensively! If she has three years related experience she will probably have enough points to apply for PR, the salary required for this route is $45k.

Thanks for the advice, I think we will have to go down the PR route. Our main problem is trying to convince the company to hire her now as they have said that they will need to prove that they have offered it to a NEw Zealander first - does anyone know if they will still need to do that if we apply for PR as opposed to applying for a work permit?
