Hi all,

I'm about to apply for indefinite RRV and I'm toying with the idea of applying for PR in Australia afterwards. Can anyone speak from experience or book smarts about potential hazards of doing so? I'm fearful that NZ may revoke my IRRV in the future if they see that I also have PR from Australia.

I'm not sure that they could do that to be honest, but I don't have any hard facts about the issue either way, sorry :)

Been there, done that- wasn't a problem for me but I am a partner of a Kiwi, which I know gives me an advantage.

The IRRV form doesn't ask you about your future intentions to remain in NZ in the future (citizenship application does- but again is ambiguous as it only (and can only really) asks about your intention at the point of applying).

I've had a look over the form and the guide notes and here is what it says: (this only applies if you arrived AFTER October 1995)

Also note that my understanding is that you will NOT be issued a IRRV or RRV if you have a current Australian PR as you can come and go in NZ with that alone- however I *think* this then impacts on your ability to get NZ citzenship- time spent in Australia does not count toward it. I'd double check that before taking it as gospel though- was my understanding at the time.

I'd get the IRRV if possible because when I left NZ I had no idea I'd be wanting to return so quickly ....


Indefinite
You qualify for an “indefinite” RRV if:
• you held a Residence Permit at a time which was
a minimum of 2 years before the date your current
application for an RRV is made, and
• you can demonstrate a commitment to New Zealand
by meeting the requirements set out in any one of the five
situations below.

Time spent in New Zealand
You have held residence permits for a total of 184 days or
more in each of the two 12 month portions of the 24 months
immediately preceding your RRV application.

Tax Status
You have held residence permits for a total of 41 days or
more in each of the two 12 months portions of the 24 months
immediately preceding your RRV application, and you are
assessed by the Inland Revenue Department as holding
tax residence status for the two years preceding your RRV
application.

Investment in New Zealand
You have been approved residence under the Investor
Category and met any requirements imposed under
section 18A of the Immigration Act 1987; or obtained
residence under another category and maintained an
investment of NZ$1,000,000 in New Zealand for two years.

Business in New Zealand
You have obtained residence under any category and
have successfully established a business in New Zealand
not less than 12 months ago which is trading successfully
and benefiting New Zealand in some way.

Established base in New Zealand
You have held residence permits for a total of at least 41
days in the 12 month period immediately before lodging
your RRV application, and:
all members of your immediate family • who were included
in your residence application have resided in New Zealand
for a total of at least 184 days in the two year period
immediately before lodging your RRV application; and
• you own and maintain a family home in New Zealand; or
• you have been genuinely employed full time in New
Zealand, in paid employment, for a total of at least 9
months in the two year period immediately before lodging
your RRV application.
Note: you are considered to own and maintain a family
home in New Zealand if you own a residential property that
you bought within 12 months of being granted a residence
permit; and you, or members of your immediate family who
were included in your residence application, live there

Thanks for the replies!

Hopefully I should have IRRV within '15 working days'. (cutting it a bit close to a planned trip ...) I have been holding off pursuing anything with Oz until i have that.

I'm still a little hesitant to move forward with Oz PR, given my experiences with the US, where the law seems completely up to the interpretation of the individual sitting behind the desk. I'd really hate to lose NZ PR.

By the way, just in case it confuses anyone else who is wondering about (I)RRV, if you satisfy this criteria:
"Time spent in New Zealand
You have held residence permits for a total of 184 days or
more in each of the two 12 month portions of the 24 months
immediately preceding your RRV application."

you can then skip any sections on the form (NZ 1004) asking about additional ties to NZ. (and then all you need is your passport in the application.)

Yes thankfully it's a pretty straightforward form. I just get tense filling paperwork like this out.

I've only really been to WA so far, and quite liked it. I'm in pursuit of the endless summer idea, and would love to split time between NZ and somewhere else a little warmer. I need to check out more spots in Oz first before coming to any conclusions though. I like to keep my options open. :-)

Wow, that was fast. Just took 3 days to process IRRV and send it back!

But then again, all they had to do was lookup the fact that I had satisfied the time requirement (as opposed to looking up proof of business, investment, establishing a base, etc etc).

I guess it's go time with Oz application. Cheers!

Can I ask if you applied for the IRRV on the 2nd year anniversary of being in NZ? I read the guidance and wonder if you can apply half way through year 2 (after 184 days). I'd like to know if you have to wait the full 2 years as my wife's UK passport expires next year and I wonder how best to time the 2 applications.

You must wait the full 2 years before applying for IRRV.

For IRRV, I ended up waiting not just 2 years after being in NZ, but 2 years after I activated PR. I believe that's the requirement.

That unfortunately meant having to pay to get stickers transferred to a new passport after 1 year, (an extra $140 or so?) but it's only money!
