Hi, I need some help with EOI

I have sold my Business in SA and will be getting a monthly income from this for the next five years. I was hoping not to work for a while to settle the kids and just have some time to myself. My problem is this:

1. I have 105 points. Any point in submitting this and hoping for the best?

2. I have a JO (outside Auckland) that will take this to 165 but I fear that
if I include this, they might grant WTR and I will then be stuck in that job
for 2 years - which I really don't want to do. If I got PR, I would have to
take up the job for 3 months - is that correct? Or will I have to prove to
immigration that I am working after that?

3. Hubby is going over in October to find a job, so the alternative is to wait
for him to find skilled employment and make him the principal applicant.
It would just be easier for him to job hunt with PR, which is why I
wanted to start the app now.

I suppose what I need to know is, can the Principal Applicant not work?

What should I do?

Hi, and welcome to the forum.

1. It is possible to be selected at 105 points, you may have to wait a while to be selected - really just depends on how many are in the pool.

2. If you have a job offer then they won't grant you a WTR (unless of course that is what you apply for). You only get a WTR if you apply for a PR and don't have a job offer, it then it gets converted to a PR once you secure one. If you do have a job offer, then yes it will likely have a section 18A attached which normally means you have to work in that job for at least 3 months.

AFAIK, after this time you would be free to do whatever you want to do (or not do in your case).

I am very nervous about this EOI as the last thing I want is to be stuck in a job for two years!

I was told that if you do not have a high score on EOI they might grant WTR even with a JO to see if you can settle, OR is this only if you do not have enough points and the job actually qualifies you??. Maybe I understood wrong.???

So this should be safe then. I submit EOI with the JO, get PR and work for three months and that's that??

I am actually looking to buy the business where I got a JO. But the old man is in no hurry. So I wanted to take some time off, have a look around and then maybe buy the business or not.

Will I then be able to buy the business without applying for a business visa?

Getting a WTR instead of a PR is given if they don't think you will settle, this is certainly not given if you have a job offer and at any rate this type of WTR is actually only given for a max of 9 months and will be converted to PR after 3 months in a job. So even if you were given a WTR instead (which you won't) you will still get PR after 3 months and in this case as you have been in the job for 3 months you shouldn't have any conditions attached (same net result).

Technically, if you are wanting to run a business then you should apply for LTBV instead of PR, but there isn't anything to stop someone who arrives on
PR then starting a business.

If you are at all unsure on your options, then you should seek professional immigration advice.

Been undecided for some time now, but this sorts it for me.
