i love all these photographs of mountains etc - but i've been there! my hub, on the other hand, hasn't, and is beginning to worry there is little else. am going to start a thread for recommended restaurants, city corners etc...

nice way to spend a day though - if you were here you'd likely have been in traffic. congratulations on the anniv

Well we've been up and down mountains on several continents and I could NEVER get bored of them. :laugh

As for restaurants.. there are always good restaurants in every town, but there's only one Mt Cook on the South Island :nice1

Thread for restaurants would be good though.. being a foodie myself I'm always interested to know where the good ones are...

You know what? Tough old Moorf "I'll never get homesick" had a little pang of it today !!! I am putting it down to jet lag and tiredness and a little culture shock (even though it does feel a little like we flew all the way round the world and ended up back in the UK (did I mention the rain?!!)).

We are totally happy with what we have seen so far - we tramped round a supermarket or two to see if we would starve but it all looks FINE!!

Oh yes Pleccy, I sure do - but not as much as I used to.

The initial whirlwind of moving here, getting sorted, getting hubby a job (he's principal applicant), finding a rental, sorting bank a/c, budgeting and all the rest really took it's toll on me. At first it would be every other day that I'd feel low (I describe it as "low" but really it's a horrid, horrid feeling of lonliness / what the hell have I done / I've lost everything / etc) - I literally couldn't get out of bed at one point and at other times I'd demand that Warren hand over my return ticket to the UK! :eek

BUT.. after a couple of months.. yes MONTHS , not weeks.. those days are few and far between and the good days have taken over. I don't expect to feel totally fine with everything for a few more months yet. I need to get past family anniversaries, friends weddings, get-togethers etc and STILL feel I want to stay before I can honestly say that I am settled and here for good. In fact, I do have a "back up" thought which I use and that is that I pretend that I am only here for 5 yrs! Don't ask me why I do that... but it works for me!! :nice1

We all have our tricks of coping and for me if I feel really fed up I just block it. If I start to get a case of the if onlys, or the other negative thoughts they just start to spiral round and get bigger and bigger, total out of proportion so if I feel like that I just blank it Misery feeds on misery and it can get really debilitating. At least I dont get like that very often, mainly because we have been so busy setting up the ski business and the backpackers, but it does creep in when you least expect it. We have left in the UK a foster daughter with an 11 year old son who used to live with us right up until we left and I only have to see a grubby blonde lad with glasses and it gets to me (especially if the glasses are held together with tape!!). Thank goodness for messenger and web cams. The other thing is the more you do and the more people you meet the less melancholy thoughts you have. also for us the dogs are a big help, get a lot of comfort from them.

as a rower i developed a technique i fondly call 'wallowing'. when in ultimate pain i jack in the stiff upper lip, instead winge, moan and occassionally weep to the depths of my soul for a quarter hour and then move on. sometimes even lie on the floor on my back (when your legs hurt too much to climb the stairs and crawl into bed this is especially good) and gaze at the ceiling - its wierdly therapeutic and at times fascinating.

sounds wierd, cant explain but always feel better.

I GOT MY WORK PERMIT AND WORK VISA TODAY :P :P

In fact, I got 4! :uhoh Well, firstly they have put a Permit AND a Visa in my passport, but they screwed up the first set of 2 and had to stamp VOID all over them and then they issued them with the CORRECT leaving date :roll: Glad I spotted their mistake as otherwise I'd have had to leave the country next weekend!! :?

Was it easy? Yes... very. I made an appt to see my case officer at the Chch office for 10am today.. I took along a letter from my husband Warren which stated he was my hubby and that he had a job and visa etc and how long we'd been married. I also took his passport with his Work Visa in it.. plus my marriage cert and, of course, a completed application form.

I think I was nearly a dead woman in the Immigration Office.. there was a huge queue and I just waltzed past them all and said I had an appt oooh if looks could kill - I think some of them had been camping there for weeks by the state of them :eek - I was whisked to a corner where I gave in my bits, he said come back in an hour. I came back an hour later, smuggly walked past the SAME people in the queue :laugh and he handed me my passport ... DONE (well, except for the date issue but he sorted that in mins!!).

So, if you are in NZ and have a case officer allocated for your ITA... contact them for visa's etc and you'll be whizzed through.. :nice1

Warren had to queue back in November when he went for his Work Visa - he had to wait for FIVE hours. This is because we had no Case Officer at the time as we only got our ITA on Xmas Eve.

The people queueing and filling out forms etc are waiting to be seen by an immigration officer but not an allocated one.

well, this morning i'm off for a blood test in wimbledon. its the 3rd time they've drawn it. the first bottle top was the wrong colour, then they re-did test only to have lab say no-go????? and throw it out. i am taking a good book and pyjamas.

yesterday i went to the local sorting office (3rd time - maybe its putney???) to retrieve ita only to find a MAJOR sort office closes at 1pm. on the positive side, at least they didn't have the 20-strong unmoving line of saturday am.

I can't say whether that would be a good thing or not Jo as we were here before we got our ITA... and I'd hate to advise you to do something that I know little about... for instance, I don't know if Immigration holds database of ITA's in progress that they might be able to refer to at the airport immigration desk when you arrive which might then look strange if you were on visitors visas? (I think this cropped up on another thread somewhere..) :?

BUT.. having said that, there is nothing to stop anyone coming across on a Visitors Visa and then applying for a Work Visa... gets confusing!

Best bet would be to ask your Case Officer! They aren't half as "strict" as I thought they would be.. mine almost took my out of date med report saying "hmm I guess I COULD get them through" but then when I said hubby's also ran out same time he said "see if you can get them re-signed here in NZ, if not, talk to me and we'll see what we can work out" !!!!

Going back to the point someone made earlier, Pam & Matt arrived on Visitors visa's having already received there ITA and assigned a case officer and they didn't have any problem with immigration when they arrived?!

Tara - I'll comment on the ease of purchasing once everything is sorted :P but yes, we viewed the house for a 2nd time with the agent, sorted our "conditions" (which were minimal as we have approved finance already in place.. this helps GREATLY!) and then the owners came back from their walk and we bounded figures about with agent who was back and forth between us and the sellers (us on balcony, them in lounge!) we finally agreed on $295 (a mere $4k below their asking but HEY, you've gotta try and that's enuf saved for a lounge suite!!).

We have only last week sent our diploma's to the NZQA to have them assessed. But thats another step on the road to NZ.

Seems that houses on hills can have easement probs as drainage of water / sewerage more often than not goes through the property and they are not always council owned, especially if subdivided section etc.

Having nightmare with solicitors as the Title to the property was never updated when subdivided. Have been advised this is a very common problem so buyers please be aware.

Don't rely just on the LIM (thank god we inserted a condition re Title too) - LIM can be approved and sale progress and yet you don't know the state of the Title! In the UK the solicitors tend to do council searches and land searches as a matter of course but not here. :no

We have had a 2 day extension granted by the vendors solicitors to get this sorted (we were due to have agreed everything by Monday 5pm - its now today 5pm). If we do not satisfy ourselves by tonight then the offer is void and we would have to re-offer or walk away. http://tcwozere.co.uk/smileys/ac39.gif

Not looking good... am gutted. This is third house we've loved that we'll probably have to walk away from.

Currently waiting to hear from solicitor to see if vendors will updated Title at their expense... would need another extension to contractual dates .. will just have to wait and see.

It does seem another of those Kiwi "can't be arsed" scenarios whereby they'd rather wait for a buyer who doesn't dig deep enough rather than stump up the cash to sort out their paperwork :roll:

It's a waiting game now. :(

This is REALLY testing my willpower re smoking.... :wah

As a UK Legal Eagle I'm curious as to the system over there. As the title is apparently "defective", isn't it the case that the vendors HAVE to rectify it at their cost in order for a sale to be achieved? It sounds as though they've put the onus on your solicitor to sort it out, and within an unrealistic timeframe. Shouldn't they be worried that you'll walk? :?

Private drains under section 461

Under section 461 of the Local Government Act, one property owner may, with the consent of his neighbour, construct a drain through that neighbour's property to connect with a council main. The legislation creates rights that appear like those that might otherwise be created by survey and Land Transfer grant of easement.

At first, section 461 seems to provide a cheap and swift solution to what is otherwise a little slow and expensive. The drain can be installed and everyone is happy.

The problem comes later. In my experience the record in the Land Registry is rarely completed. The titles then do not disclose the existence of the private drain to those coming to have an interest in either the land benefiting from the drainage rights, nor, more particularly, those interested in the neighbouring property through which the private drain passes.

So what? The time bomb explodes when a later owner of the neighbouring property undertakes earthworks that result in a broken sewer.

If the property owners have changed over the years, how could they know of the sewer? If the proper procedures have not been followed through, there is nothing on the title, as there is no registered Land Transfer easement.

An inspection of the property records of the council by requesting the familiar LIM, or Land Information Memorandum, will probably disclose the neighbour's consent filed on the records of the property which has the benefit of the drain and not on the records of the neighbouring property through which the drain passes. A purchaser of the neighbouring property all too often will not discover any indication of the sewer.

The time bomb can be averted by ensuring that an easement properly appears on the Land Transfer records. The short cut of using consent under section 461 of the Local Government Act is, without title notification, just a time bomb waiting to explode.

Property owners and councils considering private drainage under sections 460 and 461 of the Local Government Act should ensure that the provisions of those sections are all observed, including provision of the appropriate cetificate, survey and registration on the title. Alternatively a Land Transfer survey should be undertaken and a Transfer of Grant of easement registered.

By going beyond the form of a consent under section 461 of the Local Government Act we identify the best practice for the protection of our clients. The hidden time bomb of potential liability in respect of drains that are inadequately notified can, and should, be avoided.

Our problem being exactly as outlined.. the info on sewers, easements etc has not been updated with the Land Registy and therefore does not show on the Title.

Please please correct me if I am wrong with my descriptions, am by no means knowledgeable about this scenario but am trying to learn fast!

All makes sense to me. Can your solicitor not make the entry at the land registry when registering the transfer to you? Register both at the same time? The important thing is that he/she is now aware of it. I wouldn't have thought it would be a deal breaker but I do know their system is slightly different to ours. Quicker for a start!!! :clap

If they supply us with the plans showing the exact tract of the drainage/easement then yes, I expect it would go through nicely... we are currently waiting to see if they a) have official survey/plans and easement cert or if b) they need to get all this done (or are WILLING to get it done)... :?

A common mistake buyers make, whatever side of the world their on, is that they get tunnel vision and panic if something is coming between them and the key to the door. Try not to lose sight of the fact that the vendors want to sell as much as you want to buy. You've (potentially) got your pick of ANY property up for sale, and the vendors will know that. I don't imagine they'll want to lose you and I would have thought they will be having kittens at the thought of losing you. Communication is everything in this sort of situation. Talk to the vendors directly and reassure them that you still want the property and that you are happy to give THEM time to resolve the problem. Remember that the agents have their own agenda so it's better if you can speak to the vendors directly. You can then hopefully see that each of you is sincere and its only a matter of time before this glitch is sorted.
This is their burden at the moment. Don't make it yours!!

We had until Monday 5pm to approve sale etc. Luckily we got an extension from Vendors to end of today. If their solicitor/vendor won't approve another extension then our offer is void and we have to re-offer!!

My point is simply that this problem will be discovered by the next buyer, if they pull the plug on you. It isn't a situation of your making and if I was the vendor, I would be worried about you cutting and running because my title is defective.

I figure that someone, somewhere will glean useful info or be made aware of situations by mine and others experiences on this site.

With respect to purchasing a house.. a little known/used "condition" of sale is as follows (and this is one of our conditions which, basically, saved us!!) :-

"This Agreement is conditional upon the approval by the Purchaser's solicitor of the Title to the Property within xx working days of the date of this Agreement. This condition is inserted for the sole benefit of the Purchaser".
