Just received an email from NZ Immigration saying that our EOI was declined. Reason? claiming points on immediate skills shortage qualification and not on long term skill qualification :confused: I was suprised, but could not say anything, because we dont knoe for sure if is correct or not.
So ok, not 140 points as claimed, but still have 110 without qualifications on skills shortage, and remain in the pool (that's what I thought). But the officer that answered to us was evaluating our eoi at 85 points, not recognising any of my 10 years of experience.
I was really suprised by their action, especially that the letter was filled with paragraphs from the immigration law, saying
"Work experience undertaken in a country not listed at (a) above will be assessed as being in a comparable labour market only if it was undertaken for a multinational commercial entity (including a wholly or majority owned subsidiary of such an entity that bears the same core name as the parent company) domiciled in one of the countries listed in (a) above."
I have replied to the officer and explained that the work experience was indeed gained in multinational entities fullfilling the above mentioned criteria but she still refuses to accept it. Is this discrimination???? why if everything is stated clearly they can reject your work experience just because they want to? :mad:
Just wandering if the first part (rejecting qualif as skill shortage) is correct? :no
Anyway, just wanted to share with you a bad experience this time

The responsibility of the officer is to ensure the robustness of the system, and to make sure that NZ only get the migrants it wants. If you have been caught telling lies on your EOI, then I'm sure there'll be very little sympathy from anyone
They classify comparable labour markets as follows
Australia Japan
Austria Malaysia
Belgium-Luxembourg
New Zealand
Canada Netherlands
Cyprus Norway
Denmark Philippines
Finland Portugal
France Republic of South Korea
Germany Singapore
Greece Spain
Iceland Sweden
Ireland Switzerland
Israel South Africa
Italy United Kingdom
United States
The section about international companies is there to cover people who are on secondment within a company, as an example if you are an excutive manager with Coca Cola, and are posted to manage a plant in Mexico, then you're ok. If your a mexican hired locally to work in the plant, then your not.
the book says
Work experience is also assessed as being in a comparable labour market if:
<LI class=listroman>it was undertaken for a multinational commercial entity that is domiciled in one of the countries listed in (a) above; and
the work was undertaken in a country not listed in (a) above by a person who is a citizen or permanent resident of one of the listed countries and had the lawful authority to work in that country.
Unless you are a lawful permanent resident in one of the above countries, you can not claim points for work exp. Regardless of the company.

Wow - Id totally read that wrong then! (Not that it applied for us anyway) - but I thought it meant that someone working (and living) for Coca Cola anywhere would get the points becaue the COMPANY is multinational.

it's got to be that way, to stop people working as cleaners in the nokia factory in china claiming points for a comparable labour market.
<extreme example I know, but you get my point>

I live in Romania and I had 4 friends who have been invited to apply under same circumstances. The last one who left was working as IT specialist for Philip Morris in Romania, being a Romanian citizen, and they have recognised his experience as acceptable and claimed 20 points for this.
My qualifications are as Chartered accountant, I have already 6 years as management positions in company similar to Coca-cola (liked the example :D ) so I believe they ONLY want people with PR in the listed countries.

What a nightmare! We had a similar experience, we had claimed points for qualification of long term skill shortage (after being advised by NZIS that we were able to!), and therefore work experience as well, however our CO rejected the qualification as not being the correct level (we were Level 3, LTSS was level 4). And because of this our CO would not accept our work experience ! We were granted the 50 points for the trade qualification anyway, but no bonus points for the qualifications or any of his work experience....
Are they saying that they wont recognise your work experience because of your qualifications or because of the countries of where you worked? And is your qualification on the skill shortage list? I'm only asking because on our rejection letter they stated the reasons as being that a plumber is not on the LTSS, but my partner is a joiner!!! :confused: Which is on the LTSS, so mistakes can happen.....We got round the whole confusing issue because luckily a job offer came through.

it's wonderfull to see your posting, I am glad you understand what are we going through. They are rejecting my work experience because my qualification is not on LTSS, but only on immediate short list. Anyway, considering the work experience without claiming points for skilled work, we should get about 20 points.
Our CO says the work experience is gained in Romania and Romania is not one of the listed countries. And the funny thing is that my work experience goes for point b. at multinational entities but they still dont recognise it.
I'm really glad for you that you managed to get a job, I believe this is the only way for us to...
