Hi,
I'm new here and would like to ask your assistance regarding my problem below:

I'm a PR visa holder in NZ and currently living in Wellington. I'm separated de facto from my husband who is left in my home country. We have a 5 y/o son living with my parents back home. I was not able to include him in my application for residency because my husband refused to sign the permit allowing our son to be removed from his country of birth (we are not in good terms). So I left and applied alone.

I'd file a petition for full custody for my child but I'm thinking that I don't have enough money and time yet (I need to go home to our country and file myself). So I'd planned to file for that later and just bring my son here first so he could start studying here (year 1).

Is it ok to just apply him a Visitor's Visa, then extend his stay upto 9 months every year? Or is it more practical (and better) to apply for a Student's visa for him for the meantime while I wait for the right time to file for full custody. If I could apply SV or VV, can I do it here? Or my parents will need to do it back home? Also for SV, will I be required to present my husband's approval?or is it ok to apply for his SV (without my husband's signature) and as a single parent?

as far as i know your son will need a students visa if he is going to be in school for more than 3 months. less than 3 months can be done on a visitors visa. if he hasn't got an application for residence in progress then you may have to pay international school fees as he wont be classed as a domestic student.

'Got some follow-up questions though.
If I would apply him a students visa:

1. Will I still need the father's signature (or permit) to allow him to go out of the country for a long time?
2. Can I apply him here at NZ? or can my parents do it in our home country?

As far as I know your sons father WILL have to sign his consent.

I think you need the father's permission just to get him on the plane, the airline will ask for it.

Just to add - you cant get a visitors visa for 9 months EVERY year. The Visitor visas are for 6 months in a year. You can get them extended to 9 months, but then they require you to NOT be here for the next 9 months. So if you want 9 month VV - its 9 months out of 18 months.

You could get 3 x 3months visas in an 18 months period I guess, but I cant see how that would help in this case.

Im sorry there is not better news :(
