After reading this forum and finding loads of useful advice I now need some help. We are applying for WTR visa on the basis of going out to work with my brother in his company. He is in Central Otago (Cromwell) and has been unable to find anyone in the area to work with him. He has advertised in the local papers and interviewed a few people but they are unable/ unwilling to do the manual work required for the landscaping/ lawnmowing business. We would be investing in the business and re mortgaging our house to take money with us to support ourselves should the business not expand as quickly as expected.
NZIS have initially refused us on the basis that they feel the job offer is not genuine and is only a way to get into the country. This is simply not true. We have provided loads of paperwork for them including the job advert in the Cromwell paper; Employers forms and job offer, all details of our remortgage etc etc.

Can you think of anything else we could tell them to persuade them? We have 7 days from yesterday to give them more evidence.

I know this all appears vague but we are unsure what else we can tell them. Any help or advice would be appreciated.

Im fairly sure that one of the checks that NZIS do is to contact Work and Income to see if they have anyone registered on benifits who they feel could do the job. This may have been a basis for them turning you down. Im not sure how you could check this out though.

Well considering the job that hubby will be doing doesn't seem to be on the LTSL, or ISL then there ain't no chance of WTR in my eyes. And by the sounds of it, its, and i don't want to sound disrepectful, it sounds like a labouring job. As for you investing in the business, well i'm sure there has to be more substantial evidence needed for immigration. What i am trying to say is i could just invest in a window cleaning round and i would become a partner so then become a business owner. Not exactly helping the NZ economy. I do apologise if i am coming across as being a bit derogatory, this is not suppose to sound that way, but i am probably being realistic. Maybe the best way is to come in on a work visa,which you will be granted i'm sure and take the next steps from here in NZ.
This is how the catagories work:

Permanent Residence - Skilled Migrant category
You can only apply for this if you have enough points without a job offer. Getting a job offer wont count for any additional points as its not considered to be a skilled occupation. Working in NZ wont count for additional points for the same reason.

Work to Residence (accredited employer)
You can get a work visa if you have a job offer from an accredited company. Annual salary must be more than $45k. After 2 years with that company if you are still on more than $45k you are entitled to apply for permanent residence.

Work to Residence (Long Term Skills Shortage)
Your occupation is not currently on the LTSSL so you can’t take this route.

Work permit
Your occupation is on the immediate skills shortage list so a job offer from any NZ company would entitle you to a temporary work permit but this wouldn’t entitle you to permanent residence.
