Dear all,
Since my spouse's IELTS is to expire in April 2004, I am thinking of submitting our EOI as soon as we can. Otherwise, he has to repeat the exam. I am actually hesitant with this bold move bec. we only have 115pts based on our self-assessment. Although we are coordinating with an agent for a job offer, it is still unclear at this point. Would anyone know if the employment offer could be submitted after the filing of EOI? Is it possible to present the actual offer upon PR visa application?

This is a tricky one! From what you have said about retaking the exams you may face a situation whereby at the time of EOI submission your points may be OK but upon submission of the supporting documents when invited to apply for PR it could no longer be current!

On the issue of claiming points for a job offer you need to have this offer in place to claim points for it! However you can still enter the pool without it and yes if you get a job offer you can in theory submit the extra information as your circumstances change. SO if you get a job offer and further points you can amend your EOI and increase your chances.

As you may of gathered from other threads today the EOI process is poised to start moving next week and fortnightly draws from the pool are expected.

I think you need to submit you EOI asap before the IELTS expires you may then want to plead a case later on that the IELTS expired because the one month closure of the category delayed your plans but to do this you need to act quickly otherwise its back to swating I'm afaid to revailidate the IELTS. Check this out with NZIS before you submit!

Thanks Karl for the advise. One more question. Do I need an IELTS cert before filing the EOI? My exam is scheduled on the 28th, result will be out 2 weeks later.

Hi Jenkins,

Based on your information I think you will stand the best chance and save money in the process by waiting a couple of months before lodging your EOI this will allow you to sort out the IELTS situation to the satisfaction of NZIS and try to get an all important job offer. If you get a job offer lodge your application after you get your IELTS sorted!

Currently with 115 points its is doubtful you will be sucessful in the early months of the EOI pool as the back log is cleared and settles down to a more realistic level which I expect to be around the 110-130 within the next 6 months or so. In which case nothing is to be gained by applying now..Wait until next week to see the results of the first dip and then monitor it on a fortnightly basis. When it starts to fall sharply then lodge your application.

This way your 3 month stay in the pool will be tactically better spent!

This is only my advice..I'm no expert!

Principal applicants* under the General Skills category meet the minimum standard of English if:
they provide a Test Report Form (no more than 2 years old at the time the application is lodged*) from the International English Language Testing System (IELTS), showing they achieved an overall band score of at least 6.5 in the IELTS General or Academic Module; or
they provide evidence that the qualification(s) for which they have been awarded points:
was gained as a result of a course or courses of study in which English was the only medium of instruction; and
(if that qualification was gained in New Zealand) the qualification had a minimum completion time of at least two years or it is a post graduate qualification and the applicant has an undergraduate qualification that may be awarded a minimum of 10 points; or
they provide other evidence which satisfies a visa or immigration officer that, taking account of that evidence and all the circumstances of the application, the person meets the minimum standard of English. These circumstances may include but are not limited to:
the country in which the applicant currently resides;
the country(ies) in which the applicant has previously resided;
the duration of residence in each country;
whether the applicant speaks any language other than English;
whether members of the applicant's family speak English;
whether members of the applicant's family speak any language other than English;
the nature of the applicant's current or previous employment (if any) and whether that is or was likely to require skill in English language;
the nature of the applicant's qualifications (if any) and whether the obtaining of those qualifications was likely to require skill in English language.
Any person other than the principal applicant* included in an application under the General Skills category meets the minimum standard of English if:
they provide a Test Report Form (no more than 2 years old at the time the application is lodged*) from the International English Language Testing System (IELTS), showing they achieved an overall band score of at least 5 in the IELTS General or Academic Module, or
they provide evidence that they have an English speaking background (see G6.5.1) which is accepted by a visa or immigration officer as meeting the minimum standard of English; or
they provide any of the evidence outlined in paragraph (a) (iii).
In any case, a visa or immigration officer may require an applicant to provide an IELTS certificate in terms of paragraph (a)(i). In such cases, the IELTS certificate will be used to determine whether the applicant meets the minimum standard of English.
Note: IELTS is an international organisation that provides an assessment of ability in English. Its General and Academic Modules provide band totals (test results) showing overall ability as well as performance in listening, reading, writing and speaking.
