Hi everybody from Richard and Sophie, (and a big HI to all the Brummies on board - 'Or-Roight!' Nice One )

We are new to the forum and wish we'd found it sooner, seems to be a great community. Smile Smile

Regarding the family sposorship (Adult child), we understood at Emigrate 2004 that if you have a greater number of relatives in NZ you can proceed with an application - sadly the rules upon study state that if you have a direct relative or more than one in your current country of residence then you cannot be sponsored.

At present my wife's father and brother are living in NZ and have been for nearly 20 years, she has an elder brother here in the UK who we probably see less and communicate with less than the family in NZ. That, to me spells out a 'Centre of Gravity' without taking into account the emotional load, whereas the paperwork disagrees.

Is it likely that this understanding could be flexible with the NZIS? Or would a short term move to say Wales or Scotland count as being resident in another country without any direct relatives.
I know it's still the UK etc, but I reckon being Scottish is the next best thing to being a Kiwi and every Scot alive would proudly tell you it is another country.

Anybody have any opinions on this or extra info? fingers crossed

Cheers

Would seek the advice of an immigration consultant if I were you. Doesn't seem very fair as 2/3rds of your wifes family are in NZ but that does seem to be the rules.
My parents are applying under parent category as my brothers been in NZ for 11 years and 'centre of gravity' wise they're ok as only have two children. I'm able to apply as a sibling once my parents are legally resident in NZ, which I'm going to do.
Would moving to Europe for 6-12 months be out of the question? Ireland perhaps, as no language problems? Could even try Guernsey where I live, although cost of living here would be far greater and getting a right to work here can be difficult.

Best of luck to you!

Hello Captain,

I'd be interested to hear others' thoughts but, as far as I can recall from the last time I read through the rules, you would qualify. Would you mind pasting here the rules that you think work against you?

I spoke to an immigration official about this some time back and she told me that all of the parts of the UK are treated as one country - so, sadly, this wouldn't work.

Unfortunately the 'centre of gravity' rule only comes into play for parents in the family category. For adult child/sibling you can't have immediate family on your current country of residence, regardless of how many others are in NZ..

It sounds like Scotland/Wales are out of the question, but as Craig pointed out it wouldn't take much to set up residency in France or somewhere. It does seem a bit extreme, but I don't think you'd need that long there, and a few months in France wouldn't be so bad, well, perhaps it would, but better than nothing!
You'd need to look into this a bit deeper to make sure it's viable, and don't forget you'll also need a job offer in NZ..

Thanks for the input all,

It's a shame about Scotland and I think that arranging 2 relocations within a couple of years could be a bit far ranging.

I might still politely argue the toss if i'm ever near NZ House to see if there's any flexibility. On the upside though, my wife has re-registered as a mental nurse after a 7 year career break so we can start applying EOI's in around 18months ish.

It's just that everyday there seems to be something new in the news that convinces you to get going...eh?
