Does anyone know a cheap lawyer? The visa agency we have been using in uk have just dropped my case after a whole year as they have decided it is not strong enough to obtain a long term business visa.
They have had all the facts and quite a lot of my money since last July, so I am not a happy bunny.
Maybe I should just have a go at the paperwork myself and be damned with the outcome.
Or maybe we could go to Nz as assylum seekers. There must be a case against this govt. somehow. |

I'm so sorry Timbo.
How on earth can they take that long to decide that it wasn't a viable proposition. That's ridiculous. Surely that's what they are there for to advise you straight away what your chances of success are.
I feel disgusted on your behalf. Hope you have some come back on them. |

Very sorry to hear that Timbo...
I'm sure you could spread the name of the visa agency if you wanted to (by PM for interested parties???)
Just a couple of ideas;
1. Could you get a "standard job" as an employee for now, just to get you over there and started off in NZ? They seem to be pretty short of any kind of tradesman at the moment, so it might not be too difficult.
2. Do you enough points to move to NZ without a definite job offer, now it's dropped to 115 or so? Being there in person must surely help you find a job?
However p*ssed off you might feel with the agency, it must still be worth finding out their reasoning behind the decision before you think about applying yourself? They may well have taken too long about it, but they might have a valid reason for their decision.
Easy for me to say this, I know...
Good luck,
Graham |

Timbo
Very sorry to here your bad news - a real bummer - Just a thought you may have legal cover under an insurance that you already hold e.g. household. I know that my company provide a free third party legal helpline service - if you are employed you may have the same entitlement.
I would be interested in hearing the details of your case as it looks like I may be taking the same entry route to PR.

Hi Timbo,
What can I say that hasn't already been said!
My advice before you give them a piece of your mind is to get an accurate account of why the case was dropped on company letterhead. As others have suggested get legal advice form your insurers or CAB. You may also contact the office of fair trading if you think you have been mislead (or trading standards).
Keep cool at this stage and negotiate a strategic withdrawl...i.e. attempt get your money back first.
Jamie Smith (on this forum LTBV's are his business) might be able to look at your case as an impartial advisor or may even take on your case on if he thinks its viable?????
Karl ....... Chin up where theres a will theirs a way! (or an inheritence) |

Gutted for you Timbo,
A good pro for the regulation of Visa Agents though, surely there would be some more upfront code of practice.

Hi, Timbo,
I can't imagine how angry and disappointed you must be. Wish I had a magic wand to wave it all away and let you wake up tomorrow in NZ. It's hard to think what legitimate reason they could have for delaying so long in giving you the "benefit" of their advice... I wish you luck in pursuing a successful outcome.
All the best, Rae |

Hi Timbo
Feel so sorry for you, this is terrible. I thought agents weren't supposed to take money off you unless it was successful and you only paid a small amount initially.
Go to the CAB, you could persue it through the small claims and the CAB should be able to give you advice about how to do this.
Put in an EOI as soon as possible, did I read somewhere that you have 105 points ?
Thinking of you and wishing you the very best of luck.

Agree with everyone else - shocking behaviour by the agent. They should know better, this is people's hopes and dreams for the future they are messing with here. Keep us posted, but make sure you give them all hell.
If you have 105 points you should deffo bung in an EOI sharpish. Speaking with my immigration consultant earlier today (OK, OK, you may have a very dim view of such people at the moment!), he thinks points may stick at 115 for a little while now to deal with increased cases pulled from the pool recently, but points tally could well drop again before end of year, possibly followed by rises in 2005 depending on how they are going on filling the quota. Seems a lot of what is happening with SMC at the moment is politically motivated, saving face, election year, economic pressure that sort of thing.
Of course continually moving the points tally by such a wide margin does call into question the credibility of the whole SMC policy but, hey, who cares? Lets take it while we can!

Boy am I glad I found this site. THANKYOU to every one for the great moral support, it has worked wonders.
Yes I am keeping a cool head Karl, I dont want to spoil for a fight just yet.
I have been given a couple of direct contacts within nzis, so may be able to winkle some answers out of them with luck.
If it were not for the good info. and advise i have found on this forum, I dont think I would know enough to fight my corner effectively.
